1. About BidBuy Golf

BidBuy Golf (“the Platform”) is an online classifieds marketplace that connects buyers and sellers of golf-related products. The Platform is operated by Focus Media Digital. BidBuy Golf does not sell products directly; it provides a space where registered users can list items for sale, auction, or exchange.

2. Acceptance of Terms

By registering for an account, listing a product, or using any feature of BidBuy Golf, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree, you must not use the Platform.

3. User Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.

4. Listings & Content

Users may post listings for golf equipment, apparel, accessories, and related products. All listings are subject to moderation. The Platform reserves the right to remove any listing that violates these Terms, is fraudulent, misleading, or inappropriate. By posting content, you grant BidBuy Golf a non-exclusive, royalty-free license to display your content on the Platform.

5. Transactions Between Users

BidBuy Golf is not a party to any transaction between buyers and sellers. All negotiations, payments, shipping, and delivery arrangements are made directly between the users involved. The Platform does not:

  • Process payments for user-to-user transactions (except for subscription plans)
  • Guarantee the quality, safety, or legality of items listed
  • Guarantee that a buyer or seller will complete a transaction
  • Bear responsibility for any disputes between users

6. Disclaimer of Liability

The Platform is provided “as is” without warranties of any kind. BidBuy Golf and Focus Media Digital shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of the Platform or any transactions between users, including but not limited to: loss of money, damaged or defective products, products not received, fraud or misrepresentation by other users, or personal injury resulting from in-person meetings.

7. User Responsibilities When Negotiating

When using the “Close Deal” (Cerrar Trato) feature to negotiate privately with another user, you acknowledge that:

  • You are entering into a private conversation at your own risk
  • You are solely responsible for verifying the identity and trustworthiness of the other party
  • You must agree on price, payment method, and shipping or pickup details directly with the other user
  • You should inspect any product before completing payment whenever possible
  • You must comply with all applicable local laws regarding the sale and purchase of goods

8. Prohibited Conduct

You agree not to use the Platform to: list stolen, counterfeit, or illegal goods; engage in fraud or misrepresentation; harass, threaten, or abuse other users; spam or send unsolicited commercial messages; attempt to circumvent Platform features or security measures; or create multiple accounts to evade bans or restrictions.

9. Subscription Plans

BidBuy Golf offers optional paid plans (Plus, Premium, Unlimited) that provide additional listing quotas. Plans are billed monthly or annually via WooCommerce and PayPal. Refunds are subject to the refund policy displayed at checkout. The Platform reserves the right to modify plan pricing with 30 days notice.

10. Intellectual Property

All Platform branding, design, code, and original content are the property of Focus Media Digital. User-generated content remains the property of the respective users, subject to the license granted in Section 4.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy. We collect and process personal data only as necessary to provide the service.

12. Modifications

BidBuy Golf reserves the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Colombia. Any disputes shall be resolved in the courts of Bogotá, D.C.
